Terms of service
These terms govern your access to and use of Artdentified, operated by ARTDENTIFIED ApS, CVR 46698452, Denmark ("Artdentified", "we", "us"). By creating an account, listing artworks or placing an order you agree to these terms. Sections marked as applying to artists form part of the agreement between Artdentified and the artist; sections applying to buyers form part of the agreement between Artdentified and the buyer.

Marketplace
Artdentified is an intermediary platform, not a seller. We connect collectors directly with Danish emerging artists, and the sales contract for each artwork is entered into between the buyer and the artist, who sells in their own name. For our intermediary service we charge a 10% commission to the artist and a 10% fee to the buyer, and Danish VAT of 25% is added to each of them. The buyer pays the buyer fee plus VAT on that fee; the artist’s commission plus VAT on that commission is deducted from the artist’s payout. All prices shown on the platform already include the buyer fee and VAT, so the price you see is the price you pay.
The artist’s listed price is the amount the artist wants to receive before our commission. The 10% seller commission is calculated from that listed price, and 25% VAT is added to the commission, so the artist is paid the listed price minus the commission and its VAT (12,5% in total). The 10% buyer fee is calculated separately from the same listed price, and is never deducted from the artist’s payout.
Eligibility and accounts
You must be at least 18 years old and legally able to enter into a binding agreement to use the platform. You must provide accurate and complete information, keep it up to date, and keep your login credentials confidential. You are responsible for all activity under your account and must notify us immediately of any unauthorised use. We may suspend or close an account that breaches these terms, is used for fraudulent or unlawful activity, or where required by law.
Artist warranties and responsibilities
By listing an artwork, the artist represents and warrants that the artist is the sole creator and legal owner of the work, that the work is an original hand-made work (or a clearly identified edition or reproduction stated as such), that it is free of any lien, pledge, consignment or third-party claim, and that it does not infringe the copyright, trademark, personality or other rights of any third party.
The artist is responsible for the accuracy of every listing, including title, year, technique, materials, dimensions, condition, framing and edition details, and for packing the work securely for transport. The artist must hold all necessary registrations and is solely responsible for their own tax and VAT obligations relating to their sales.
Copyright and image rights
The artist retains full copyright in their works. Sale of a physical artwork does not transfer copyright or any right of reproduction to the buyer; the buyer acquires ownership of the physical object only.
The artist grants Artdentified a non-exclusive, royalty-free, worldwide licence to use images, text and other material supplied by the artist, or produced by Artdentified in connection with the collaboration, for the purpose of presenting, promoting and documenting the artist and their works on the platform, in newsletters, in press material and on social media. The licence continues after the end of the collaboration for archival and documentation purposes and for material already published. The artist is credited by name wherever reasonably possible.
All rights in the platform itself, including software, design, database, trademarks and editorial content produced by Artdentified, belong to Artdentified. You may not copy, scrape, mine, resell or reverse-engineer any part of the platform.
VAT on artworks
Because Artdentified acts as an intermediary and each artist sells in their own name, the artist’s first-hand sale of their own original works is exempt from VAT registration and payment as long as the artist’s annual turnover from such sales does not exceed 350.000 kr. within a calendar year (Danish VAT Act § 69, stk. 4 and § 47, stk. 1). The threshold also covers the artist’s other goods and services up to 50.000 kr. Below the threshold the artwork itself is sold without VAT, which applies to most artists on Artdentified.
VAT liability takes effect from the sale that causes the threshold to be exceeded, and applies to that sale and all subsequent sales for the remainder of the calendar year and the following calendar year. When registered, first-hand sales by the artist in their own name are taxed at 25% of a reduced base of 20% of the sale price (approximately 5% effective, Danish VAT Act § 71 e). Reproductions such as prints and posters are always subject to standard 25% VAT, with a registration requirement above 50.000 kr. in turnover.
Payment, settlement and payouts
Payments are processed by Stripe. The collector pays the full displayed price at checkout, funds are held while the work is shipped, and Artdentified automatically generates a settlement statement for the artist. The statement shows the artwork amount, our 10% seller commission, 25% VAT on that commission and the net amount to be paid out. The net amount is transferred to the artist’s connected Stripe account after delivery is confirmed. The buyer fee and VAT on it are invoiced separately by Artdentified to the collector and are never part of the artist’s payout.
To receive payouts the artist must complete Stripe’s onboarding and identity verification and accept Stripe’s own terms. Payouts can be withheld where a transaction is disputed, suspected to be fraudulent, or where the artwork has not been delivered as described.
Right of withdrawal for consumers
A buyer who is a consumer has a statutory right to withdraw from the purchase within 14 days of receiving the artwork, without giving a reason, in accordance with the Danish Consumer Contracts Act. The period runs from the day the buyer, or someone designated by the buyer, takes physical possession of the work, and the buyer may also withdraw at any time before then. To exercise the right, notify us at hello@artdentified.com before the deadline expires; a clear statement by email is sufficient. The artwork must then be returned without undue delay and no later than 14 days after the notification.
The buyer pays the direct cost of returning the artwork and is liable for any reduction in value caused by handling beyond what is necessary to establish the nature and characteristics of the work. Once notice of withdrawal has been given, we refund the artwork amount, the buyer fee including VAT on it, and the standard outbound delivery cost paid at checkout, using the original payment method. If the buyer chose a more expensive delivery method than our standard option, only the standard cost is refunded. Works made to order or personalised to the buyer’s specification are exempt from the right of withdrawal.
Refunds are issued no later than 14 days after we receive notice of withdrawal, although we may withhold the refund until the artwork has been returned or the buyer has documented that it has been sent back. Refunds are free of charge for the buyer and the buyer is not charged any fee for exercising the right of withdrawal.

A consumer may use the following form to exercise the right of withdrawal, but is not required to do so. Send it to ARTDENTIFIED at hello@artdentified.com.
Refunds and cancellations
Because the artist is the seller of the artwork, a refund of the artwork amount is made on behalf of the artist and is reversed against the artist’s payout or connected account. Artdentified refunds its own buyer fee, including VAT on that fee, when the sale of the artwork is fully cancelled or returned. Partial refunds are settled proportionally.
Consumers also have a two-year right of complaint under the Danish Sale of Goods Act for defects present at delivery. Such claims are directed at the artist as the seller; Artdentified assists in handling them.
Authenticity and provenance
Every work offered on the platform is presented as an original work made by the artist listed, unless the listing expressly states that it is an edition or a reproduction. The artist warrants the authenticity, authorship and provenance of each work. A signed certificate of authenticity is provided on request: the buyer can request one from us at any time before or after purchase, and we obtain it from the artist and forward it to the buyer. If a work is shown not to be authentic or not to match the listing in a material respect, the buyer is entitled to cancel the purchase and receive a full refund, including fees and delivery costs, and the amount is recovered from the artist.
Identity checks and anti-money-laundering
Artists must complete identity verification through Stripe before receiving payouts. For high-value transactions, or where a transaction appears unusual, we may request additional documentation of identity, of the source of funds and of the provenance of a work, and may delay or decline a transaction until it is provided, in accordance with the Danish Anti-Money Laundering Act. We do not accept cash payments.
Sales, commission and artwork availability
If contact between an artist and a buyer is established through Artdentified, including via the platform, an enquiry facilitated by Artdentified, or any other activity related to Artdentified, Artdentified is entitled to the agreed commission on any subsequent sale between the artist and that buyer, regardless of whether the transaction is completed on or off the platform.
The artist may not complete or assist in completing a transaction outside the platform for the purpose of avoiding payment of Artdentified's commission. If such circumvention is established, it will be regarded as a breach of the collaboration and may result in immediate termination of the collaboration. Artdentified also retains the right to the commission that would have been due had the sale been completed via the platform.
The artist is responsible for ensuring that information about the availability of artworks on the platform is correct at all times. If an artwork is sold or otherwise no longer available, for example as a result of a sale at an exhibition, through a gallery, or directly to a buyer, the artist must inform Artdentified as soon as possible.
If, due to failure to update, an artwork continues to appear as available and is subsequently sold via the platform, the artist will receive a written warning in the first instance. In case of repetition, Artdentified may terminate the collaboration.
Contract formation, language and storage
Displaying an artwork on the platform is an invitation to buy, not a binding offer. A binding contract between the buyer and the artist is concluded when we send the order confirmation by email on the artist’s behalf. Before you complete the order you can review and correct your details in the basket and at checkout. Contracts are concluded in English. We store the order details and confirmation and make them available to you through your account and by email; they are kept for five years as required by the Danish Bookkeeping Act.
Orders and shipping
Artworks are shipped directly by the artist. At launch we sell and ship to buyers within the EU/EEA only. Estimated delivery is 2–5 business days within Denmark, 3–8 business days within the EU, and 5–15 business days for other EEA destinations. The shipping cost is calculated at checkout from the size, weight, fragility, packaging requirements, artist location and delivery address, and is always shown including VAT in the basket and at checkout before the order is placed. For oversized, particularly fragile or high-value artworks, a custom shipping quote may be required. No shipping charges are added after the order is placed. Returns are handled in accordance with the consumer right of withdrawal described above and with the statutory rules on defective goods. Order confirmations and receipts state the artist as the seller of the artwork and Artdentified as the supplier of the platform service.
Unless a longer period is expressly agreed for a particular work, the artwork is delivered without undue delay and no later than 30 days after the order is placed. If delivery does not take place within that period, the buyer may set an additional reasonable deadline and, if delivery still fails, cancel the purchase and receive a full refund of everything paid.
Risk of loss or damage passes to the buyer when the artwork is handed over to the buyer. Where the buyer has arranged their own carrier, risk passes when the work is handed to that carrier. Ownership of the artwork passes when the full amount has been paid.
Acceptable use
You may not use the platform to publish unlawful, offensive, defamatory or infringing material, to misrepresent your identity, to circumvent fees, to interfere with the security or operation of the service, or to collect data about other users for unsolicited marketing. We may remove content and restrict access where these rules are broken.
Availability of the service
We aim to keep the platform available at all times but do not guarantee uninterrupted operation. Maintenance, updates and technical faults may cause downtime. We may change, restrict or discontinue features, and will give reasonable notice of material changes that affect artists with active listings.
Liability
Artdentified acts solely as an intermediary and is never the seller of the artworks. The artist is the seller, and any dispute concerning an artwork is between buyer and artist.
Artdentified is not liable for indirect or consequential loss, including loss of profit, loss of data, or loss of goodwill. To the extent permitted by law, our total liability in relation to any claim is limited to the fees and commission Artdentified has received in connection with the transaction the claim concerns. Nothing in these terms limits liability that cannot be limited under mandatory Danish law, including liability for gross negligence, intent, or a consumer’s mandatory rights.
The artist indemnifies Artdentified against claims from third parties arising from the artist’s breach of these terms, including claims relating to authenticity, ownership or infringement of intellectual property rights.
Term, termination and suspension
The collaboration with an artist runs until further notice and can be terminated by either party with 30 days’ written notice by email. Orders already placed at the time of termination are completed on these terms, and commission remains payable on them. In case of material breach, either party may terminate with immediate effect. On termination, listings are removed from the platform.
Force majeure
Neither party is liable for failure to perform caused by circumstances beyond its reasonable control, including war, natural disaster, epidemic, strike, failure of payment infrastructure, or major failure of internet or hosting services.
Personal data
We process personal data as described in our privacy policy and use cookies as described in our cookie policy.
Notices and changes to these terms
Notices are given by email to the address registered on your account and are considered received the following business day. We may amend these terms; material changes are announced by email or on the platform at least 30 days before they take effect, and continued use after that date counts as acceptance. Orders already placed are governed by the terms in force at the time of the order.
Ranking and presentation of artworks
Artworks and artists are displayed in a curated order determined by Artdentified. Search results are ranked by relevance to the user’s search query and selected filters. Placement cannot be bought: we do not currently offer paid placements, promoted listings or sponsored search results, and Artdentified does not give its own or affiliated listings preferential treatment. Where we highlight works editorially, this is done on curatorial grounds and is marked as a curated selection.
Restriction, suspension and termination of artist accounts
If we restrict or suspend the listings of an individual artist, we give that artist a statement of the reasons on a durable medium before, or at the latest when, the restriction takes effect. If we terminate the collaboration entirely, we give at least 30 days’ notice together with the reasons, unless we are subject to a legal obligation to act otherwise, act in response to repeated breaches of these terms, or can demonstrate illegal or fraudulent conduct. An artist may contest a decision through the internal complaint procedure below, and we reinstate listings without undue delay where the decision was taken on the basis of incorrect information.
Internal complaint handling and mediation for artists
Artists can raise complaints about our decisions, about technical issues, or about measures affecting them by writing to hello@artdentified.com. We aim to respond to complaints within 48 hours on weekdays, examine each complaint individually and provide a reasoned outcome within a reasonable time. Complaints and their outcomes are handled free of charge.
If a complaint cannot be resolved internally, we are willing to engage in good faith in out-of-court mediation with the Danish Mediation Institute (Mediationsinstituttet, Copenhagen, Denmark) or another mediator agreed between the parties. Willingness to mediate does not prevent either party from bringing proceedings before the courts.
Data access
Artists have access, through their account, to the data they provide and to the data generated by their own sales, including listings, orders, settlement statements and payout history. Aggregated statistics about the platform as a whole, and data about other artists or about individual buyers beyond what is needed to fulfil an order, are not shared. On request we provide an export of an artist’s own data.
Reporting illegal or infringing content
Anyone can notify us of content on the platform they consider illegal, infringing or otherwise in breach of these terms by writing to hello@artdentified.com, which is also our point of contact for authorities and users. A notice should identify the exact page or listing, explain why the content is considered unlawful, and state the name and email of the person notifying us, together with a confirmation that the notice is made in good faith.
We confirm receipt without undue delay, assess the notice diligently and without arbitrariness, and inform the notifier of the outcome and of the available means of redress. Where a notice is upheld, the content is removed or disabled and the artist concerned is given the reasons and the opportunity to respond. Repeated infringement leads to suspension.
Artists as sellers and trader information
Artists sell on the platform in the course of their artistic business and act as traders towards consumers. Before listing, an artist must provide their name, address, email, phone number and, where applicable, CVR number, and keep this information accurate. We make the seller’s identity available to the buyer in the order confirmation and on request. Where a seller is not a trader, this is stated on the listing, and the consumer rights described above do not apply to that sale; statutory rules on non-conforming goods between private parties apply instead.
Complaints and disputes
Complaints can always be sent to hello@artdentified.com, and we aim to respond within 48 hours on weekdays. Where we mediate between a buyer and an artist, our assessment is a recommendation and is not binding on either party.
A consumer who has complained to us and is not satisfied with our response may file a complaint with the Danish Competition and Consumer Authority’s Center for Klageløsning, Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark (forbrug.dk), where the complaint can be submitted online and a fee applies. This does not affect the right to bring the matter before the ordinary courts.
Governing law and venue
These terms are governed by Danish law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Disputes are heard by the Copenhagen City Court, unless mandatory rules give a consumer the right to bring the case in another venue.
Miscellaneous
If any provision is found invalid, the remaining provisions stay in force. You may not transfer your rights under these terms without our consent; we may transfer the agreement in connection with a merger, acquisition or transfer of business. These terms, together with the policies referenced in them, constitute the entire agreement between the parties.
